If a temporary resident has lost their status or allowed their authorization to work or study to expire, they may apply to restore that status in accordance with the section under the Immigration and Refugee Protection Regulations (IRPR).

It’s crucial to understand that an applicant can only restore to the authorization they held immediately prior to the restoration application.

– Temporary residents are only permitted to apply to restore their status and authorization to what they held immediately before the need for restoration arises.

For students:

– Those who previously held a study permit and lost their status can apply within Canada to restore their temporary resident status and study permit.

For workers:

– Individuals who held a work permit and lost their status can seek restoration within Canada, provided they do so within 90 days of losing their status.

Regarding visitors:

– Visitors who have lost their status can apply for restoration as temporary residents within Canada.

Eligible temporary:

residents can also apply for work or study permits during the restoration process. However, fees for these permits must be paid separately from the restoration fee.

For holders of Temporary Resident Permits (TRPs):

– TRP holders whose permits have expired are ineligible for restoration.

– They must instead submit an application for a new TRP if they wish to prolong their stay in Canada.
